Convention relative aux garanties internationales portant sur des matériels d’équipement mobiles et son Protocole portant sur les questions spécifiques aux matériels d’équipement aéronautiques, faits au Cap, le 16 novembre 2001 - Adhésion par l’Islande.
Il résulte d’une notification de l’Institut international pour l’unification du droit privé (UNIDROIT) qu’en date du 23 juin 2020, l’Islande a adhéré à la convention et au protocole aéronautique désignés ci-dessus, qui entreront en vigueur à l’égard de cet État le 1er octobre 2020.
Dans le contexte de son adhésion, l’Islande a émis les déclarations suivantes :
Déclaration en vertu de l’article 39(1)(a)-(b) de la convention
Pursuant to Article 39 of the Convention, Iceland declares that:
(A) any non-consensual right or interest under Icelandic law existing at the date of this declaration or created after that date, that has priority over an interest in an object equivalent to that of the holder of a registered international interest shall to that extent have priority over a registered international interest, whether in or outside insolvency proceedings.
(B) nothing in in the Convention shall affect the right of the Government of Iceland, or that of any entity thereof, governmental entity, intergovernmental organization or other private provider of public services to arrest or detain an object under the laws of Iceland for payment of amounts owed to that government, entity, organization or provider directly relating to those services in respect of that object or another object.
Déclaration en vertu de l’article 40 de la convention
Iceland declares that for purposes of Article 40 of the Convention a non-consensual right or interest arising under Icelandic law in which an object is subject to attachment or seizure (including provisionally), shall be registrable under the Convention as regards any category of object as if the right or interest were an international interest and shall be regulated accordingly.
Déclaration en vertu de l’article 53 de la convention
Pursuant to Article 53 of the Convention, Iceland declares that the District Court of Reykjavik (Héraðsdómur Reykjavíkur) is the relevant court for the purposes of Article 1 and Chapter XII of the Convention.
Déclaration en vertu de l’article 54(2) de la convention
Pursuant to Article 54(2) of the Convention, Iceland declares that any remedies available to the creditor under the Convention may be exercised without court intervention or action unless the intervention of the court is expressly required by the provisions of the Cape Town Convention.
Déclaration en vertu de l’article 55 de la convention
Pursuant to Article 55 of the Convention, it is declared that where the debtor is domiciled in the territory of a European Economic Area, the Member States bound by The Lugano Convention 1988 and 2007 on jurisdiction and the recognition and enforcement of judgements in civil and commercial matters, will apply Articles 13 and 43 of the Cape Town Convention for interim relief only in accordance with Article 31 of the 2007 Lugano Convention interpreted in the context of Article 24 of the 1988 Lugano Convention on jurisdiction and the enforcement of judgments in civil and commercial matters.
Déclaration en vertu de l’article XXX(1) du protocole aéronautique
Pursuant to Article XXX(1) of the Aircraft Protocol, Iceland declares that it will apply Articles VIII, XII and XIII.
Déclaration en vertu de l’article XXX(2) du protocole aéronautique
Pursuant to Article XXX(2) of the Aircraft Protocol, Iceland declares that it will apply Article X in its entirety and that the number of working days to be used for the purposes of the time-limit laid down in Article X(2) shall be in the respect of remedies specified in subparagraphs (a), (b) and (c) of Article 13(1) of the Convention no more than 10 calendar days and in respect of the remedies specified in subparagraphs (d) and (e) of Article13(1) of the Convention no more than thirty 30 calendar days.
Déclaration en vertu de l’article XXX(3) du protocole aéronautique
Pursuant to Article XXX(3) of the Aircraft Protocol, Iceland declares that it will apply in entirety Alternative A of Article XI to all types of insolvency proceedings and that the waiting period for the purposes of Article XI(3) is 60 days.
Déclaration en vertu de l’article XXX(5) du protocole aéronautique
Pursuant to Article XXX(5) of the Aircraft Protocol, Iceland declares that Article XXI of the Protocol will not apply within the European Economic Area. The Lugano Convention 2007 and 1988 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters will apply to this matter for the Member States to the said Lugano Convention.
